Oakland Raiders linebacker Rolando McClain will not face jail time after being arrested on misdemeanor assault and firearms charges for allegedly holding a gun beside a man's head in Alabama, the player's lawyer told ESPN's Adam Schefter.
Decatur Municipal Judge Bill Cook originally had sentenced McClain to 180 days in jail after convicting him of third-degree assault, menacing, reckless endangerment and discharging a firearm in the city limits. However, McClain's lawyer appealed that ruling, and Morgan County Circuit Judge Glenn Thompson dropped the case earlier this month after the man who made the accusations declined to pursue it, ESPN reported, citing court documents. It's unclear why the man made that choice.
It's also unclear if the NFL will punish McClain for the incident despite the case being dropped. We contacted NFL spokesman Greg Aiello about if the league still could punish McClain, and he said all such incidents are reviewed as standard procedure.
Players have faced NFL discipline in the past without being convicted, but obviously the charges being dropped help McClain's chances of avoiding punishment.
