NFL Forward Pass

THIS PROGRAM IS OPEN TO CANADIAN RESIDENTS ONLY AND IS GOVERNED BY CANADIAN LAW

1. Key Dates:

The NFL Forward Pass (the "Program") is sponsored by NFL Canada. The Program begins on Thursday, October 23^rd at 12:00:00 a.m. Eastern Time ("ET") and continues through January 15^th, 2026 at 11:59:59 PM ET (the "Program Period"). The Program Period consists of two (2) phases (each a "Phase") as follows:

Phase One: NFL Forward Pass Nomination Period (the "Nomination Period")

• Starts: October 23^rd, 2025 at 12:00:00 a.m. ET
• Ends: December 5^th, 2025 at 11:59:59 p.m. ET

Phase Two: Judging/Review – selection of 3 NFL Forward Pass Regional Winners

• Ends: January 15^th, 2026 at 5:00:00 p.m. ET

* Voting Period will consist of a 48 hour period to be announced on the www.nfl.com/forwardpass website

2. Eligibility to Make a Nomination or to Vote:

To participate in the Program and make a nomination (a "Nomination") as a nominator (a "Nominator") during the Nomination Period or to vote during the Voting Period, you must be a resident of Canada who: (i) has reached the legal age of majority in your province/territory of residence at the time of participation; or (ii) is between the ages of thirteen (13) and the legal age of majority in your province/territory of residence (each, a "Minor") – provided your parent/legal guardian has consented to your participation in the Program and has accepted and agreed to be legally bound by these Official Terms (the "Terms") on your behalf.

NOTE TO MINORS: NFL reserves the right, in its sole and absolute discretion, on a random audit basis to contact a Minor's parent/legal guardian for the purposes of verifying his/her: (i) agreement to be legally bound by these Terms on the Minor's behalf; (ii) consent to the Minor's participation in this Program; and/or (iii) consent to the collection, use and disclosure of the Minor's personal information. Failure of a Minor's parent/legal guardian to complete any such required verification to the complete satisfaction of NFL within the time frame specified by NFL may, in the sole and absolute discretion of NFL, result in disqualification of the Minor.

FOR THE AVOIDANCE OF ANY DOUBT, THE NOMINATOR AND/OR VOTER HAS NO RIGHT TO CLAIM ANY DONATION OR A PORTION THEREOF.

3. Eligibility to be Nominated:

To participate in the Program and receive a Nomination as a nominee (a "Nominee") and to receive a Donation, you must be a Canadian Football Organization/Association that: (i) has an established financial process to help families in need; (ii) provides sporting opportunities to at least fifty (50) youth football players in Canada (iii) has certified coaching staff; (iv) a player safety program and/or policies; and (v) abuse and harassment training and/or policies (an "Association").

Any and all actions contemplated in these Terms on behalf of an Association must be completed by an authorized representative of the Association (each a "Representative") who: (a) is a resident of Canada; (b) has reached the legal age of majority in his/her province or territory of residence; (c) resides in Canada during the Program Period and at the time of fulfillment; (d) has authority and permission from the Association to participate in the Program on behalf of the Association; and (e) has the authority to legally bind the Association – including, without limitation, to these Terms and to any other required documentation as contemplated in these Terms.

FOR GREATER CERTAINTY AND THE AVOIDANCE OF ANY DOUBT, THE REPRESENTATIVE IS NOT THE NOMINEE AND HAS NO RIGHT TO PERSONALLY CLAIM ANY DONATION OR A PORTION THEREOF. THE NOMINEE IN THIS PROGRAM IS THE ASSOCIATION.

NFL reserves the right, in its sole and absolute discretion at any time, to disqualify any Association if NFL determines that allowing the Association to participate in the Program could bring NFL into public disrepute or in any way impact the good standing or reputation of NFL in the eyes of the general public or if it is discovered that the Nomination and/or Application was not compliant with these Terms. NFL's decisions on all matters arising in this regard shall be final and binding without right of appeal.

4. How to Make a Nomination:

No purchase necessary. MAKING A PURCHASE WILL NOT INCREASE OR OTHERWISE IMPACT THE OPPORTUNITY TO RECEIVE A DONATION IN RELATION TO THIS PROGRAM.

During the Nomination Period, an eligible Nominator can make a Nomination by going to **www.nfl.com/forwardpass** (the "Website") and following the onscreen prompts to obtain and fully complete the Official Nomination Form (the "Form") with all required information – including, but not limited to: (i) the Nominator's full name and contact details (the "Nominator"); (ii) the full name and contact details of the Association; and (iii) a 150 to 500 word (English or French) written submission (a "Submission") that describes how the Association achieves all of the following concepts:

• REACH those in the community in need of financial assistance
• INSPIRE youth to fall in love with the sport
• SUPPORT youth in developing life skills they can use off the field
• ENCOURAGE diversity and inclusion in the community through football initiatives

To be eligible, all content and materials associated with a Nomination (collectively, the "Nomination Materials") must: (i) be submitted and received during a Nomination Period; (ii) include all required components and materials noted above; and (iii) be in accordance with these Terms, including, but not limited to, the specific Submission Requirements listed below in Section 8 (all as determined by NFL in its sole and absolute discretion).

5. Nomination/Application Limit and Conditions:

The following limits and conditions apply to Nominations and Applications in the Program:

• An eligible Nominator cannot submit more than one (1) Nomination/Application in relation to the same Nominee.
• The same Nominee can be nominated by multiple eligible Nominators in accordance with these Terms and the Program Judges decision will determine which one (1) Nomination moves the football organization/association forward.
• An eligible Nominator who is affiliated with an Association can complete a Nomination/Application for that Association.

If it is discovered by NFL (using any evidence or other information made available to or otherwise discovered by NFL) that any person has attempted to use multiple names, multiple identities, multiple email addresses, any automated, macro, script, robotic or other system(s) or program(s), and/or any other means not in keeping with NFL's interpretation of the letter and/or spirit of these Terms to participate in or to disrupt this Program; then he/she may, in the sole and absolute discretion of NFL, be disqualified from the Program. NFL, its associated and affiliated entities, advertising/promotion agencies and all other individuals and entities involved in the development, production, implementation, administration, judging or fulfillment of the Program (collectively with NFL, the "Program Parties"), and each of their respective agents, employees, directors, successors, and assigns (collectively, the "Released Parties") are not responsible for, and accept no liability whatsoever in relation to lost, late, incomplete, damaged, inaccurate, stolen, delayed, misdirected or undelivered Nominations, Applications and/or Nomination Materials or Application Materials or votes, or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), Website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Program, including, without limitation, errors or difficulties which may occur in connection with the administration of the Program, the processing or judging of Nominations, the tabulation of votes, the announcement of the prizes or in any Program-related materials.

A Nomination or Application may be rejected if, in the sole and absolute discretion of NFL: (i) the Nomination/Application (including, but not limited to, any associated Nomination or Application Materials) are not submitted and received in accordance with these Terms during a Nomination or Application Period; and/or (ii) the Nomination/Application Materials accompanying the Nomination or Application are not in compliance with these Terms (including, but not limited to, the specific Submission Requirements listed below in Section 8) (all as determined by NFL in its sole and absolute discretion).

IMPORTANT NOTE: Individuals may encourage others to submit a Nomination/Application; however, no form of incentive, inducement, prize or chance of receiving any incentive, inducement, or prize may be offered as part of such encouragement in furtherance of receiving such individual's Nomination/Application. In addition, proxy nomination schemes (or anything reasonably resembling a proxy nomination scheme, as determined by NFL in its sole and absolute discretion) are hereby expressly prohibited. Any individual or entity determined by NFL and/or its representative(s) to be engaging in any such behaviours and/or in violation of NFL's interpretation of the letter and/or spirit of these Terms (all as determined in the sole and absolute discretion of NFL) will be disqualified.

6. Verification:

All Nominations, Nomination Materials, Applications, Application Materials, votes, Associations and participants are subject to verification at any time and for any reason. NFL reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to NFL – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual's eligibility to participate in this Program; (ii) for the purposes of verifying the eligibility and/or legitimacy of any Nomination, Nomination Materials, Application, Application Materials, votes and/or other information entered (or purportedly entered) for the purposes of this Program; and/or (iii) for any other reason NFL deems necessary, in its sole and absolute discretion, for the purposes of administering this Program in accordance with NFL's interpretation of the letter and spirit of these Terms. Failure to provide such proof to the complete satisfaction of Kruger within the timeline specified by NFL may result in disqualification in the sole and absolute discretion of NFL. The sole determinant of the time for the purposes of this Program will be the official time-keeping device(s) of NFL.

7. Submission Requirements:

BY SUBMITTING A NOMINATION/APPLICATION, EACH NOMINATOR (AND HIS/HER PARENT/LEGAL GUARDIAN ON HIS/HER BEHALF IF THE NOMINATOR IS A MINOR) AGREES THAT THE NOMINATION/APPLICATION (AND EACH INDIVIDUAL COMPONENT THEREOF – INCLUDING, WITHOUT LIMITATION, THE NOMINATION/APPLICATION MATERIALS) COMPLIES WITH ALL CONDITIONS STATED IN THESE TERMS. THE RELEASED PARTIES WILL BEAR NO LIABILITY WHATSOEVER REGARDING: (I) THE USE OF ANY NOMINATION/APPLICATION (OR ANY COMPONENT THEREOF – INCLUDING, WITHOUT LIMITATION, THE NOMINATION/APPLICATIONMATERIALS); (II) PARTICIPATION IN ANY PROGRAMRELATED ACTIVITIES; AND/OR (III) ANY USE, COLLECTION, STORAGE AND DISCLOSURE OF ANY PERSONAL INFORMATION. THE RELEASED PARTIES SHALL BE HELD HARMLESS BY EACH NOMINATOR (AND HIS/HER PARENT/LEGAL GUARDIAN ON HIS/HER BEHALF IF THE NOMINATOR IS A MINOR) IN THE EVENT IT IS DISCOVERED THAT A NOMINATOR HAS DEPARTED FROM OR NOT OTHERWISE FULLY COMPLIED WITH ANY OF THESE TERMS.

By participating in the Program, each Nominator (and his/her parent/legal guardian on his/her behalf if the Nominator is a Minor) and Applicant hereby warrants and represents that any Nomination/Application Materials he/she submits:

• are original to him/her and that the Nominator has obtained all necessary rights in and to the Nomination/Application Materials for the purposes of submitting such Nomination/Application Materials in the Program;
• do not violate any law, statute, ordinance or regulation;
• do not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the legal age of majority in their jurisdiction of residence;
• will not give rise to any claims whatsoever, including, without limitation, claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party; and
• are not defamatory, trade libelous or obscene, and further that they will not contain, depict, include, discuss or involve any materials that are or could be considered inappropriate, unsuitable or offensive, all as determined by Kruger in its sole and absolute discretion.
• The Application and associated materials submitted in Phase 3 of the Program can be publicly disclosed, as presented, for the purpose of public voting in accordance with these Terms.

NFL and/or its promotional agency or designated content moderator (the "Reviewer") reserves the right to screen all Nomination/Application Materials, including voting practices. Any Nomination/Application Materials or voting practices that the Reviewer deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Terms are subject to disqualification – in which case NFL reserves the right, in its sole discretion, to take whatever action it deems necessary based on the circumstances – including, without limitation, disqualifying the Nomination/Application Materials (and therefore the corresponding Nomination and/or the associated Nominator/Nominee or vote(s)) – to help ensure that the Program is being conducted in accordance with NFL's interpretation of the letter and spirit of these Terms.

8. License:

By entering the Program and submitting a Nomination/Application, each Nominator (and his/her parent/legal guardian on his/her behalf if the Nominator is a Minor) and Applicant: (i) grants to NFL, in perpetuity, a non-exclusive license to publish, display, reproduce, modify, edit or otherwise use his/her Nomination/Application Materials (and each component thereof), in whole or in part, for advertising or promoting the Program or for any other reason; (ii) waives all moral rights in and to his/her Nomination/Application Materials (and each component thereof) in favour of NFL (and anyone authorized by NFL to use such Nomination/Application Materials); and (iii) agrees to release and hold harmless Kruger and all of the other Released Parties from and against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her Nomination/Application Materials (or any component thereof), including, without limitation, any claim based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related or other cause of action whatsoever.

9. Donations:

a) PHASE ONE – NFL Forward Pass DONATION - NOMINATION PERIOD

There will be a total of three (3) NFL Forward Pass Regional Winners (each, a "Donation", collectively the "Donations", and together with the Grand Prize Donation, "Donations") available in relation to Phase One of this Program. Each of one (1) $25,000 CAD donation by NFL to the Association. A limit of one Association will be selected from the three (3) regions as outlined below (each, "Region"):

• Western Canada (BC, AB, SK, MB, Yukon and NWT)
• Ontario
• Quebec & Atlantic (NB, NS, PEI)

NFL Forward Pass Donations provided to the Regional Winners must: (i) be used only for the purposes of supporting football registration fees and/or to help overcome barriers that prevent Canadians from playing the game for eligible families within the Association; and (ii) be used in full by December 31, 2026. The Regional Winners will be required to enter into an agreement with NFL whereby it commits to allocating the Donation in the manner that is aligned with the Program.

The following general conditions apply to each NFL Forward Pass Donation: (i) Donation must be accepted as awarded and is not transferable or assignable (except as may be specifically permitted by NFL in its sole and absolute discretion); (ii) no substitutions are permitted, except at NFL's option; (iii) NFL reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Forward Pass Donation or any component thereof; and (b) substitute the Forward Pass Donation or a component thereof for any reason with an item or item(s) of equal or greater value; and (iv) by accepting a Forward Pass Donation, the Representative (on his/her own behalf and on behalf of the Association) agrees to waive all recourse against NFL and all of the other Released Parties if the Forward Pass Donation or a component thereof does not prove satisfactory, either in whole or in part.

To the fullest extent permitted by applicable law, the Representative of each Association that is eligible to receive an NFL Forward Pass Donation hereby (on his/her own behalf and on behalf of the Association) agrees that neither the Association, nor anyone on behalf of the Association, may seek reimbursement or pursue any legal or equitable remedy from either NFL or any of the other Released Parties should the Forward Pass Donation fail to be fit for its purpose or is in any way unsatisfactory.

Each Association that is eligible to receive an NFL Forward Pass Donation is solely responsible for the reporting and payment of any taxes relating to the applicable Donation.

There is a limit of one (1) NFL Forward Pass Donation per Association in relation to the Program.

b) PHASE TWO – NFL Forward Pass JUDGING PROCESS

In relation to the Nomination Period, and during Phase Two of this Program, a panel of judges (the "Program Judges") appointed by NFL will judge each eligible Nomination on the basis of the following weighted criteria:

1. How well the Association achieves all of the following concepts:

• REACH those in the community in need of financial assistance
• INSPIRE youth to fall in love with the sport
• SUPPORT youth in developing life skills they can use outside of the field
• ENCOURAGE diversity and inclusion in the community through football initiatives

Weighting: 70%

2. Overall strength of Nomination

Weighting: 30%

Total Score - Maximum 100%

Each Nomination will be given a score (the "Score") by the Program Judges. Odds of being selected depend on the number and calibre of eligible Nominations submitted and received during the Nomination Period in accordance with these Terms.

The eligible Nominee who receives the top score (as determined by the Program Judges, in their sole and absolute discretion) in their Region will be selected as the eligible recipient of a Forward Pass Donation for that Region(subject to compliance with these Terms). There is a limit of one (1) Forward Pass Donation per Region.

In the event of a tie between two or more eligible Nominations based on Score, the eligible Nominee – from amongst all such eligible Nominations that are tied – with the highest score on Criteria 1 (followed in the event of a further tie by Criteria 2) will be selected as the eligible recipient of the Forward Pass Donation. In the event of an exact tie based on Criteria 1 and 2, a new panel of judges will be appointed by NFL to break the tie in accordance with the preceding procedure.

In the event that a Nominee is disqualified for whatever the reason, the Forward Pass Donation will be awarded to the Nominee who received the next highest score.

Judging for Nomination is scheduled to be completed on or about January 19^th, 2026

c) NOTIFICATION PROCESS

NFL or its designated representative will make a minimum of two (2) attempts to contact the Representative of each Association that is eligible to receive a Donation (using the information provided in the Nomination and/or the Application) within five (5) business days of selection of the NFL Forward Pass Regional Winner or Grand Prize winner. If the Representative of an Association that is eligible to receive a Donation cannot be contacted as outlined above, or if there is a return of any notification as undeliverable; then the Association may, in the sole and absolute discretion of NFL, be disqualified (and, if disqualified, will forfeit all rights to a Donation) and NFL reserves the right, in its sole and absolute discretion and time permitting, to select an alternate eligible Association from among the remaining eligible Nominations/Applications in accordance with Section 10 (in which case the foregoing provisions of this section shall apply to such newly selected eligible Association).

10. Confirmation Process:

NO ASSOCIATION IS A DONATION RECIPIENT UNLESS AND UNTIL NFL OFFICIALLY CONFIRMS THE ASSOCIATION AS A DONATION RECIPIENT IN ACCORDANCE WITH THESE TERMS. Before being declared AS A CONFIRMED DONATION RECIPIENT, the Representative of each Association that is eligible to receive a Donation will be required to sign and return within three (3) business days of notification NFL's declaration, release and donation form, which (among other things): (i) confirms his/her and the Association's compliance with these Terms; (ii) acknowledges the Association's acceptance of the Donation (as awarded); (iii) releases NFL and all of the other Released Parties from any and all liability in connection with this Program, his/her and the Association's participation therein and/or the awarding and use/misuse of the Donation or any portion thereof; (iv) agrees to the publication, reproduction and/or other use of the Association's name and logo without further notice or compensation, in any publicity or advertisement carried out by or on behalf of NFL in any manner whatsoever, including print, broadcast or the internet; (v) agrees to provide stories, photos, videos and other content to (a) show the cheque presentation; and (b) showcase how the Donation has had a positive impact on football families in need; (vi) agrees to distribute the Donation in a manner that has been mutually agreed upon as between the Association and NFL.

If an Association that is eligible to receive a Donation: (a) fails to have its Representative return the properly executed Program documents within the specified time; (b) cannot accept (or is unwilling to accept) the Donation (as awarded) for any reason; and/or (c) is determined to be in violation of these Terms (all as determined by NFL in its sole and absolute discretion); then he/she will be disqualified (and will forfeit all rights to a Donation) and NFL reserves the right, in its sole and absolute discretion and time permitting, to select an alternate eligible Association from among the remaining eligible Nominations/Applications in accordance with Section 10 (in which case the foregoing provisions of this section shall apply to such newly selected eligible Association).

11. General Conditions:

This Program is subject to all applicable federal, provincial and municipal laws. The decisions of NFL with respect to all aspects of this Program are final and binding on all participants without right of appeal.

ANY INDIVIDUAL OR ENTITY DEEMED BY KRUGER TO BE IN VIOLATION OF NFL'S INTERPRETATION OF THE LETTER AND/OR SPIRIT OF THESE TERMS FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF NFL AT ANY TIME.

The Released Parties will not be liable for: (i) any failure of the Website or any other website or platform during the Program; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Nomination, Application, Application Materials, Nomination Materials, votes and/or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to a participant's or any other person's computer or other device related to or resulting from participating in the Program; (v) anyone being incorrectly and/or mistakenly identified as a recipient or eligible recipient; and/or (vi) any combination of the above.

NFL reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the "Régie") in Quebec, to withdraw, amend or suspend this Program (or to amend these Terms) in any way, in the event of any cause beyond the reasonable control of NFL that interferes with the proper conduct of this Program as contemplated by these Terms, including, without limitation, any error, problem, computer virus, bugs, tampering, unauthorized intervention, fraud or failure of any kind whatsoever. Any attempt to undermine the legitimate operation of this Program in any way (as determined by NFL in its sole and absolute discretion) may be a violation of criminal and civil laws and should such an attempt be made, NFL reserves the right to seek remedies and damages to the fullest extent permitted by law. NFL reserves the right, subject only to the approval of the Régie in Quebec, to cancel, amend or suspend this Program, or to amend these Terms, in any way without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever.

For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

By entering this Program, each participant (and his/her parent or legal guardian on his/her behalf if the participant is a Minor) expressly consents to NFL, its agents and/or representatives, storing, sharing and using the personal information submitted for the purpose of administering the Program and in accordance with NFLs privacy policy (available at: https://www.nfl.com/legal/privacy/). This section does not limit any other consent(s) that an individual may provide NFL or others in relation to the collection, use and/or disclosure of their personal information.

NFL reserves the right, subject only to the approval of the Régie in Quebec, to adjust any of the dates, timeframes and/or other Program mechanics stipulated in these Terms, to the extent deemed necessary by NFL, for purposes of verifying compliance by any participant, Nomination, Nomination Materials, Application, Application Materials, votes and/or other information with these Terms, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of NFL, in its sole and absolute discretion, affect the proper administration of the Program as contemplated in these Terms, or for any other reason.

In the event of any discrepancy or inconsistency between the terms and conditions of these English Terms and disclosures or other statements contained in any Program-related materials, including, but not limited to, the French version of these Terms, point of sale, television, print or online advertising and/or any instructions or interpretations of these Terms given by any representative of NFL, the terms and conditions of these English Terms shall prevail, govern and control to the fullest extent permitted by law.

The invalidity or unenforceability of any provision of these Terms shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein.

To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms or the rights and obligations of participants, NFL or any of the other Released Parties in connection with the Program will be governed by and construed in accordance with the domestic laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law Terms or provisions that would cause the application of any other jurisdiction's laws. The parties hereby consent to the exclusive jurisdiction and venue of the courts located in Ontario in any action to enforce (or otherwise relating to) these Terms or relating to this Program.

CE PROGRAMME EST OUVERT UNIQUEMENT AUX RÉSIDENTS CANADIENS ET EST RÉGI PAR LES LOIS CANADIENNES

1. Dates Imporantes:

Le programme La Passe vers l'avant de la NFL (le « programme ») est commandité par NFL Canada. Le programme débute le jeudi 23 octobre à 0 h, heure de l'Est (« HE ») et se poursuit jusqu'au 15 janvier 2026 à 23 h 59:59 (« la période du programme »). La période du programme est composée de deux (2) phases (chacune une « phase ») comme suit :

Phase 1: Période de mise en candidature de La passe vers l'avant de la NFL (la « période de mise en candidature »).

• Début : 23 octobre 2025 à 0 h (HE)

Phase 2: Évaluation/Examen – Sélection de trois gagnants régionaux de La Passe vers l'avant de la NFL

2. Admissibilité Pour Soumettre Une Candidature Ou Pour Voter:

Pour participer au programme et soumettre une candidature (une « candidature ») vous devez être une personne qui soumet une candidature (le (la) « proposant(e) ») pendant la période de mise en candidature ou pour voter pendant la période de scrutin, vous devez résider au Canada qui a (i) avoir atteint l'âge légal de la majorité dans votre province/territoire de résidence au moment de la participation ou (ii) être âgé(e) entre treize (13) ans et l'âge de la majorité dans votre province/territoire de résidence (chacun(e) une « personne mineure »), pourvu que votre parent/tuteur(trice) légal(e) a consenti à votre participation dans le programme et a accepté et convenu d'être légalement lié(e) par ces conditions officielles (les « conditions ») en votre nom.

NOTE AUX PERSONNES MINEURES : La NFL se réserve le droit, à son entière et absolue discrétion, sur une base de vérification aléatoire de contacter le parent/tuteur(trice) légal(e) d'une personne mineure afin de vérifier son (i) accord d'être juridiquement lié(e) par ces conditions au nom de la personne mineure; (ii) consentement à la participation de la personne mineure dans ce programme; et/ou (iii) consentement à la cueillette, à l'utilisation et à la divulgation des renseignements personnels de la personne mineure. L'échec du parent/tuteur(trice) légal(e) d'une personne mineure à compléter une telle vérification requise à la satisfaction complète de la NFL dans les délais spécifiés par la NFL peut, à la discrétion unique et absolue de la NFL, conduire à la disqualification de la personne mineure.

POUR ÉVITER TOUT DOUTE, LE (LA) PROPOSANT(E) ET/OU LE (LA) VOTEUR(EUSE) N'A AUCUN DROIT DE RÉCLAMER UN DON OU UNE PORTION DE CELUI-CI.

3. Admissibilité À Être Candidat:

Pour participer au programme et être mis en candidature en tant que candidat (un « candidat ») et recevoir un don, vous devez être une organisation/association canadienne de football qui : (i) dispose d'un processus financier établi pour aider les familles dans le besoin; (ii) offre des occasions sportives à au moins cinquante (50) jeunes joueurs de football au Canada; (iii) dispose d'une équipe d'entraîneurs certifiés; (iv) dispose d'un programme et/ou de politiques en matière de sécurité des joueurs; et (v) dispose d'une formation et/ou de politiques en matière de maltraitance et de harcèlement (une « association »).

Toutes les actions envisagées dans les présentes conditions au nom d'une association doivent être accomplies par un(e) représentant(e) autorisé(e) de l'association (chacun étant un(e) « représentant(e) ») qui : (a) réside au Canada; (b) a atteint l'âge légal de la majorité dans sa province ou son territoire de résidence; (c) réside au Canada pendant la période du programme et au moment de l'exécution, (d) détient l'autorité et la permission de l'association de participer au programme au nom de l'association; (e) a l'autorité d'obliger juridiquement l'association, notamment aux présentes conditions et à tout autre document requis comme envisagé dans les présentes conditions.

IL EST ENTENDU QUE LE (OU LA) REPRÉSENTANT(E) N'EST PAS LE CANDIDAT(E) ET N'A PAS LE DROIT DE RÉCLAMER PERSONNELLEMENT TOUT DON DANS LE CADRE DU PROGRAMME OU UNE PARTIE DE CELUI-CI. LE CANDIDAT DANS LE CADRE DU PROGRAMME EST L'ASSOCIATION.

La NFL se réserve le droit, à sa discrétion exclusive et à tout moment, de disqualifier une association si la NFL estime que le fait de permettre à l'association de participer au programme pourrait discréditer la NFL ou nuire à sa réputation aux yeux du grand public, ou s'il s'avère que la personne qui soumet la candidature et/ou la demande elle-même n'a pas respecté les présentes conditions. Les décisions de la NFL quant à toutes les questions soulevées à cet égard sont définitives, obligatoires et non susceptibles d'appel.

4. Comment Soumettre Une Candidature:

Aucun achat n'est nécessaire. UN ACHAT N'AUGMENTERA PAS ET N'INFLUERA PAS L'INCIDENCE POUR RECEVOIR UN DON RELATIVEMENT À CE PROGRAMME.

Au cours de la période de mise en candidature, une personne admissible à soumettre une candidature pour soumettre une candidature en se rendant sur www.nfl.com/forwardpass (le « site Web ») et en suivant les messages-guides à l'écran pour obtenir et remplir le formulaire officiel de mise en candidature (le « formulaire ») avec toutes les informations requises, ce qui comprend, sans s'y limiter, les informations suivantes : (i) le nom complet et les coordonnées du (ou de la) proposant(e) (le (la) « proposant(e) »); (ii) le nom complet et les coordonnées de l'association; et (iii) une soumission écrite de 150 à 500 mots (en français ou en anglais) (une « soumission »)

• ATTEINDRE ceux dans la communauté en besoin d'aide financière
• INSPIRER les jeunes à tomber en amour avec le sport
• SOUTENIR les jeunes dans le développement de compétences de vie qu'ils peuvent utiliser hors du terrain
• ENCOURAGER la diversité et l'inclusion dans la communauté par des initiatives de football

Pour être admissibles, tout le contenu et tous les documents associés à une candidature (ensemble les « documents de candidature ») doivent (i) être soumis et reçus pendant une période de mise en candidature; (ii) inclure toutes les composantes et tous les documents mentionnés ci-dessus; et (iii) être conformes aux présentes conditions, notamment aux exigences de candidature particulières décrites ci-dessous à la section 8 (comme déterminé par la NFL à son entière et unique discrétion).

5. Limites Et Conditions Des Candidatures/Demandes:

Les limites et conditions suivantes s'appliquent à toutes les candidatures et demandes dans le cadre du programme :

• une personne admissible à soumettre une candidature ne peut soumettre plus d'une (1) candidature/demande relativement à la même association candidate;
• la même association candidate peut être mise en candidature par plusieurs personnes admissibles conformément aux présentes conditions et la décision des juges du programme détermine laquelle (1) des candidatures permet à l'association/organisation de football de passer à l'étape suivante;
• une personne admissible à soumettre une candidature qui est affiliée à une association peut soumettre la candidature/demande pour cette association.

S'il est découvert par la NFL (en utilisant toute preuve ou autre information mise à la disposition de la NFL ou découverte par celle-ci) qu'une personne a tenté d'utiliser plusieurs noms, plusieurs identités, plusieurs adresses de courrier électronique, tout système ou programme automatisé, macro, script, robotique ou autre, et/ou tout autre moyen non conforme à l'interprétation par la NFL de la lettre et/ou de l'esprit des présentes conditions pour participer ou perturber ce programme, cette personne peut, à la discrétion exclusive de la NFL, être disqualifiée du programme. La NFL, ses entités associées et affiliées, les agences de publicité/promotion et toutes les autres personnes et entités impliquées dans le développement, la production, la mise en œuvre, l'administration, le jugement ou l'exécution du programme (collectivement avec la NFL, les « parties au programme »), et chacun de leurs mandataires, employés, administrateurs, dirigeants, successeurs, et leurs ayants droit (collectivement, les « parties bénéficiaires de la décharge ») ne sont pas responsables et n'acceptent aucune responsabilité, quelle qu'elle soit, en ce qui concerne les formulaires, candidatures et/ou autres documents perdus, tardifs, incomplets, endommagés, inexacts, volés, retardés, mal acheminés ou non livrés, ou en cas de perte, d'interruption ou d'indisponibilité du réseau, du service, du fournisseur d'accès à Internet, du site Web ou d'autres connexions, disponibilités ou accessibilités, ni en cas de mauvaises communications, de défaillance technique ou de transmissions défaillantes d'ordinateur, de satellite, de téléphone, de câble ou de ligne, ni de transmissions confuses, brouillées, retardées ou mal dirigées, ou de dysfonctionnements, défaillances ou difficultés du matériel informatique ou des logiciels, ou autres erreurs de toute autre nature, qu'elles soient humaines, mécaniques, électroniques, informatiques, de réseau, typographiques ou d'imprimerie, ou autrement liée au programme, y compris les erreurs ou difficultés pouvant survenir dans le cadre de l'administration du programme, du traitement ou de l'évaluation des candidatures, de l'annonce des subventions ou dans tout contenu lié au programme.

Une candidature ou une demande peut être rejetée si, à la discrétion exclusive de la NFL : (i) la candidature/demande (notamment, mais s'y limiter, tout document de mise en candidature ou de demande) n'est pas soumise et reçue conformément aux présentes conditions au cours d'une période de mise en candidature/demande; (ii) les documents de mise en candidature/demande ne sont pas conformes aux présentes conditions (notamment, mais sans s'y limiter, les exigences particulières de mises en candidature indiquées ci-dessous dans la section 8) (le tout, comme déterminé par la NFL, à sa discrétion exclusive).

NOTE IMPORTANTE : les personnes peuvent encourager d'autres personnes à soumettre une candidature/demande; toutefois, aucune forme d'incitation, de persuasion, de récompense ou de chance de recevoir une incitation, une persuasion ou une récompense ne peut être offerte dans le cadre d'un tel encouragement en vue de la réception de la candidature/demande de la personne concernée. En outre, les systèmes de candidature par procuration (ou tout ce qui peut raisonnablement ressembler à un système de candidature par procuration, comme déterminé par la NFL à sa discrétion exclusive) sont expressément interdits par les présentes. Toute personne ou entité identifiée par la NFL et/ou son (sa/ses) représentant(e)(s) comme étant engagée dans de tells comportements et/ou en infraction avec l'interprétation de la lettre et/ou de l'esprit de ces conditions par la NFL (à l'unique et absolue discrétion de la NFL) sera disqualifiée.

6. Vérification:

Toutes les candidatures, tous les documents des candidatures, toutes les demandes, tous les documents de demandes, tous les votes, toutes les associations et tous les participants peuvent faire l'objet d'une vérification à tout moment et pour quelque raison que ce soit. La NFL se réserve le droit, à sa discrétion exclusive, de demander une preuve d'identité et/ou d'admissibilité (sous une forme acceptable par la NFL, ce qui peut comprendre une pièce d'identité avec photo émise par un gouvernement) : (i) dans le but de vérifier l'admissibilité d'une personne à participer à ce programme; (ii) dans le but de vérifier l'admissibilité et/ou la légitimité de toute candidature, de tous les documents des candidatures, de toutes les demandes, de tous les documents de demandes, de tout vote et/ou de toute autre information donnée (ou prétendument donnée) dans le cadre de ce programme; et/ou (iii) pour toute autre raison que la NFL juge nécessaire, à sa discrétion exclusive, dans le but d'administrer ce programme conformément à l'interprétation par la NFL de la lettre et de l'esprit de ces conditions. Le fait de ne pas fournir cette preuve à l'entière satisfaction de Kruger dans le délai précisé par la NFL peut entraîner la disqualification, à la discrétion exclusive et absolue de la NFL. Le seul déterminant des délais aux fins de ce programme est le ou les dispositifs officiels de chronométrage de la NFL.

7. Exigences De Soumission:

EN SOUMETTANT UNE CANDIDATURE/DEMANDE, CHAQUE PROPOSANT(E) (ET SON PARENT/TUTEUR(TRICE) LÉGAL(E) EN SON NOM SI LE (LA) PROPOSANT(E) EST UNE PERSONNE MINEURE) ACCEPTE QUE LA MISE EN CANDIDATURE/DEMANDE (ET CHAQUE COMPOSANTE INDIVIDUELLE, NOTAMMENT, MAIS SANS S'Y LIMITER, LES DOCUMENTS DE CANDIDATURE/DEMANDE) EST CONFORME À TOUTES LES CONDITIONS ÉNONCÉES AUX PRÉSENTES. LES PARTIES EXONÉRÉES N'AURONT AUCUNE RESPONSABILITÉ QUE CE SOIT RELATIVEMENT À : (I) L'UTILISATION DE TOUTE CANDIDATURE/DEMANDE (OU DE TOUTES COMPOSANTES DE CELLE-CI, NOTAMMENT, MAIS SANS S'Y LIMITER, LES DOCUMENTS DE CANDIDATURE/DEMANDE); (II) LA PARTICIPATION DANS TOUTE ACTIVITÉ LIÉE AU PROGRAMME; ET/OU (III) TOUTE UTILISATION, CUEILLETTE, TOUT STOCKAGE ET TOUTE DIVULGATION DE TOUT RENSEIGNEMENT PERSONNEL. LES PARTIES EXONÉRÉES DEVRAIENT ÊTRE TENUES INDEMNES PAR CHAQUE PROPOSANT(E) (ET SON PARENT/TUTEUR(TRICE) LÉGAL(E) EN SON NOM SI LE (LA) PROPOSANT(E) EST UNE PERSONNE MINEURE) DANS LE CAS QU'IL EST DÉCOUVERT QU'UN(E) PROPOSANT(E) S'EST ÉCARTÉ(E) DE CES CONDITIONS OU QU'IL NE S'Y CONFORME PAS ENTIÈREMENT.

En participant au programme, chaque personne (et son parent/tuteur(trice) légal(e) en son nom si le (la) proposant(e) est une personne mineure) et le demandeur garantit et déclare par la présente que tout document de candidature/demande qu'il/elle soumet :

• sont originaux et que la personne qui soumet la candidature a obtenu tous les droits nécessaires dans les documents de candidature/demande aux fins de la soumission de ces documents de candidature/demande dans le cadre du programme;
• n'enfreignent pas de loi, d'ordonnance, ni de règlement;
• ne contiennent aucune référence à des tiers identifiables ou à leur image, à moins que toutes ces parties et leurs parents/tuteurs légaux s'ils n'ont pas atteint l'âge de la majorité dans leur territoire de résidence, n'aient donné leur accord;
• ne donnent lieu à aucune réclamation, quelle qu'elle soit, y compris les réclamations pour violation, atteinte à la vie privée ou aux droits de publicité, ni ne portent atteinte aux droits et/ou aux intérêts d'un tiers; et
• ne sont pas diffamatoires, calomnieux ou obscènes, et ne contiennent pas, ne représentent pas, n'incluent pas, ne discutent pas ou n'impliquent pas de contenus qui sont ou pourraient être considérés comme inappropriés, inadéquats ou offensants, le tout comme déterminé à la discrétion exclusive et absolue de Kruger;
• La demande et les documents en soutien soumis dans la Phase 3 du programme peuvent être publiquement divulgués, tels que présentés, aux fins du vote du public, conformément à ces conditions.

La NFL et/ou ses agences promotionnelles ou le modérateur de contenu désigné (le « vérificateur ») se réservent le droit de filtrer tous les documents de candidatures/demande, notamment les pratiques de scrutin. Tous les documents de candidatures/demandes ou pratiques de scrutin que le vérificateur, à sa discrétion exclusive, considère comme violant les présentes conditions sont susceptibles d'être disqualifiés, auquel cas la NFL se réserve le droit, à sa discrétion exclusive, de prendre toute mesure qu'elle juge nécessaire en fonction des circonstances, notamment, mais sans s'y limiter y compris la disqualification des documents de candidature/demande (et donc la candidature et/ou le (la) proposant(e)/candidat ou le(s) vote(s) associé(e)(s)) pour aider à garantir que le programme est mené conformément à l'interprétation par la NFL de la lettre et de l'esprit de ces conditions.

8. Autorisation:

En participant au programme et en soumettant une candidature/demande, chaque personne qui soumet une candidature (et son parent/tuteur(trice) légal(e) en son nom si le (la) proposant(e) est une personne d'âge mineur) et le demandeur : (i) accorde à la NFL, une licence perpétuelle et non exclusive de publier, d'afficher, de reproduire, de modifier, d'éditer ou d'utiliser de toute autre manière ses documents de candidature/demande (et chaque composante de ceux-ci), en totalité ou en partie, pour la publicité ou la promotion du programme ou pour toute autre raison; (ii) renonce à tous les droits moraux sur ses documentes de candidature/demande (et chaque composante de ceux-ci) en faveur de la NFL (et toute personne autorisée par la NFL à utiliser ces documents de candidature/demande); et (iii) accepte de décharger de toute responsabilité Kruger et toutes les autres parties bénéficiaires de la décharge des réclamations, dommages, responsabilités, coûts et dépenses découlant de l'utilisation de ses documents de candidature/demande (ou de tout composant de ceux-ci), y compris toute réclamation basée sur les droits de publicité, la diffamation, l'atteinte à la vie privée, la violation des droits d'auteur, la violation des marques de commerce ou toute autre cause d'action liée à la propriété intellectuelle ou de toute autre nature.

9. Dons:

a) PHASE 1 – DON de la Passe vers l'avant de la NFL – PÉRIODE DE MISE EN CANDIDATURE

Il y aura au total trois (3) gagnants régionaux du programme La Passe vers l'avant de la NFL (chacun un « don », ensemble les « dons », et avec le don du grand prix, les « dons ») offerts relativement à la Phase 1 de ce programme. Chacun était un (1) don de 25 000 $CA par la NFL à l'Association. Une limite d'une association sera sélectionnée dans chacune des trois (3) régions identifiées ci-dessous (chacune, une « région ») :

• Ouest du Canada (C.-B., AB, SK, MB, YK et T.-N.-O.);
• Ontario;
• Québec et Canada atlantique (N.-B., N.-É. et I.-P.-É.).

Les dons de La Passe vers l'avant de la NFL versés aux gagnants régionaux doivent : (i) être utilisés uniquement pour soutenir les frais d'inscription au football et/ou pour aider les familles admissibles de l'association à surmonter les obstacles qui empêchent les Canadiens à pratiquer le sport; et (ii) être utilisés en entier d'ici le 31 décembre 2026. Les gagnants régionaux devront signer un accord avec la NFL, s'engageant à attribuer le don en harmonie avec le programme.

Les conditions générales suivantes s'appliquent à chaque don de La Passe vers l'avant de la NFL : (i) les dons doivent être acceptés tels que décernés et ne sont pas transférables ni attribuables (à l'exception de ce qui est particulièrement permis par la NFL à son unique et absolue discrétion); (ii) aucune substitution n'est permise, à l'exception de l'option de la NFL; (iii) la NFL se réserve le droit en tout temps de : (a) imposer des restrictions raisonnables sur l'accessibilité ou l'utilisation du don de La Passe vers l'avant ou toute composante de celui-ci; et (b) remplacer le don de La Passe vers l'avant ou une composante de celui-ci, peu importe la raison avec un (des) article(s) de valeur égale ou supérieure; et (iv) en acceptant un don de La Passe vers l'avant, le (la) représentant(e) (en son nom et au nom de l'association) accepte de renoncer à tous les records contre la NFL et toutes les autres parties exonérées si le don de La Passe vers l'avant ou une composante de celui-ci n'est pas satisfaisant, en totalité ou en partie.

Dans toute la limite permise par la loi, le (la) représentant(e) de chaque association admissible à recevoir un don de La Passe vers l'avant de la NFL (en son nom ou au nom de l'association) accepte que ni l'association, ni personne au nom de l'association, peut chercher à obtenir un remboursement ou à intenter un recours juridique ou équitable auprès de la NFL ou de toute autre partie exonérée si un don de La Passe vers l'avant ne correspond pas à son intention ou est autrement insatisfaisant.

Chaque association admissible à recevoir un don de La Passe vers l'avant de la NFL est la seule responsable de rapporter et de verser toute taxe liée au don applicable.

Il y a une limite d'un (1) don de La Passe vers l'avant de la NFL par association relativement à ce programme.

b) PHASE 2 – LE PROCESSU D'ÉVALUATION DE La Passe vers l'avant de la NFL

Relativement à la période de mise en candidature et pendant la Phase 2 de ce programme, un jury (le « jury ») nommé par la NFL évaluera chaque candidature admissible sur la base des critères pondérés suivants :

1. Comment l'association réalise-t-elle chacun des concepts suivants :

• ATTEINDRE ceux dans la communauté en besoin d'aide financière
• INSPIRER les jeunes à tomber en amour avec le sport
• SOUTENIR les jeunes dans le développement de compétences de vie qu'ils peuvent utiliser hors du terrain
• ENCOURAGER la diversité et l'inclusion dans la communauté par des initiatives de football

Pondération : 70 %

2. Force globale de la candidature

Pondération : 30 %

Pointage total : maximum 100 %

Chaque candidature recevra un pointage (le « pointage ») des juges du programme. Les probabilités d'être sélectionné dépendent du nombre et de la qualité des candidatures admissibles soumises et reçues dans votre région au cours de la période de mise en candidature, conformément aux présentes conditions.

Le candidat admissible qui obtient le meilleur pointage dans sa région (comme déterminé par les juges du programme, à leur discrétion exclusive et absolue) est sélectionné en tant que lauréat admissible d'un don La Passe vers l'avant pour cette région (sous réserve du respect des présentes conditions). Limite d'un (1) don La Passe vers l'avant par région.

En cas d'égalité entre deux candidats admissibles ou plus sur la base de leur pointage, le candidat admissible, parmi toutes ces candidatures admissibles à égalité avec le plus haut pointage au Critère 1 (suivi en cas d'une égalité qui persiste par le Critère 2) sera sélectionné comme le lauréat admissible au don de La Passe vers l'avant. En cas d'une égalité exacte sur la base des critères 1 et 2, un nouveau jury sera nommé par la NFL pour rompre l'égalité conformément à la procédure précédente.

Si un candidat est disqualifié pour une raison quelconque, le don de La Passe ver l'avant sera remis au candidat qui a obtenu le pointage le plus élevé suivant.

L'évaluation des candidatures devrait être terminée autour du 19 janvier 2026.

c) PROCÉDURE D'AVIS

La NFL ou son (ou sa) représentant(e) désigné(e) fait au moins deux (2) tentatives pour contacter le (ou la) représentant(e) de chaque association admissible à recevoir un don (en utilisant les informations fournies dans la candidature et/ou la demande) dans les cinq (5) jours ouvrables suivant la sélection du gagnant régional ou du grand prix de La Passe vers l'avant de la NFL. Si le (ou la) représentant(e) d'une association admissible à recevoir un don ne peut pas être contacté(e) comme indiqué ci-dessus, ou si une notification est retournée comme non distribuable, l'association peut, à la discrétion exclusive de la NFL, être disqualifiée (et, si elle est disqualifiée, elle perd tous ses droits à un don) et la NFL se réserve le droit, à sa discrétion exclusive et si le temps le permet, de sélectionner une autre association admissible parmi les candidatures/demandes admissibles restantes, conformément à la section 10 (auquel cas les stipulations précédentes de la présente clause s'appliquent à l'association admissible nouvellement sélectionnée).

10. Processus De Confirmation:

AUCUNE ASSOCIATION N'EST LAURÉATE D'UN DON À MOINS ET JUSQU'À CE QUE LA NFL CONFIRME OFFICIELLEMENT L'ASSOCIATION EN TANT QUE LAURÉATE D'UN DON CONFORMÉMENT AUX PRÉSENTES CONDITIONS. Avant d'être déclaré comme lauréat d'un don confirmé, le (ou la) représentant(e) de chaque association admissible à recevoir un don, doit signer et renvoyer dans les trois (3) jours ouvrables suivant la notification, le formulaire de déclaration, de décharge et de don de la NFL, qui (entre autres) : (i) confirme sa conformité et celle de l'association aux présentes conditions; (ii) reconnaît l'acceptation par l'association du don (tel qu'attribué) et des conditions liées à son utilisation; (iii) décharge la NFL et toutes les autres parties bénéficiaires de la décharge de toute responsabilité en rapport avec ce programme, sa participation et celle de l'association à ce programme et/ou l'attribution et l'usage/le mésusage de don ou d'une partie de celle-ci; (iv) accepte la publication, la reproduction et/ou toute autre utilisation du nom et du logo de l'association sans autre notification ni compensation, dans toute publicité ou annonce réalisée par la NFL ou en son nom de quelque manière que ce soit, y compris dans la presse écrite, à la radio et à la télévision ou sur le Web; (v) accepte de fournir des histoires, des photos, des vidéos et d'autres contenus pour (a) montrer la remise du chèque; (b) montrer comment le don a exercé une influence positive sur les familles de joueurs de football dans le besoin; (vi) accepte de distribuer le don d'une manière dont l'association et la NFL ont mutuellement convenu.

Si une association admissible à recevoir un don : (a) ne parvient pas à ce que son (ou sa) représentant(e) renvoie les documents du programme correctement signés dans les délais impartis; (b) ne peut pas accepter (ou ne veut pas accepter) le don (tel qu'attribué) pour quelque raison que ce soit; (c) est considérée comme étant en violation des présentes conditions (comme par la NFL, à sa discrétion exclusive); alors il/elle sera disqualifié(e) (et renoncera à tous ses droits à un don) et la NFL se réserve le droit, à sa discrétion exclusive et si les délais le permettent, de sélectionner une autre association admissible parmi les candidatures/demandes admissibles restantes conformément à la section 10 (auquel cas les stipulations précédentes de la présente clause s'appliquent à l'association admissible nouvellement sélectionnée).

11. Conditions Générales:

Ce programme est soumis à toutes les lois fédérales, provinciales et municipales applicables. Les décisions de la NFL concernant tous les aspects de ce programme sont définitives et obligatoires pour tous les participants et ne sont pas susceptibles d'appel.

TOUTE PERSONNE OU ENTITÉ CONSIDÉRÉE PAR KRUGER COMME ÉTANT EN VIOLATION DE L'INTERPRÉTATION PAR LA NFL DE LA LETTRE ET/OU DE L'ESPRIT DES PRÉSENTES CONDITIONS POUR QUELQUE RAISON QUE CE SOIT EST SUJETTE À DISQUALIFICATION À TOUT MOMENT, À LA DISCRÉTION EXCLUSIVE DE LA NFL.

Les parties exonérées ne seront pas responsables de : (i) toute panne du site Web ou de tout autre site Web ou plateforme; (ii) tout problème technique ou autre de toute nature que ce soit, notamment, mais sans s'y limiter, ceux liés au réseau ou aux lignes téléphoniques, aux systèmes informatiques en ligne, aux serveurs, aux fournisseurs d'accès, à l'équipement informatique ou aux logiciels; (iii) l'échec de toute candidature, demande, documents de demandes ou de candidatures, de votes et/ou d'autres informations reçues, saisies ou enregistrées pour une raison quelconque, notamment, mais sans s'y limiter, à des problèmes techniques ou à une congestion d'achalandage sur l'Internet ou sur tout site Web; (iv) tout dommage ou toute perte à l'ordinateur ou de tout appareil du (de la) participant(e) ou de toute personne, lié à la participation au programme ou découlant de celui-ci; (v) quiconque identifié incorrectement et/ou par erreur comme un lauréat ou le lauréat admissible; et/ou (vi) toute combinaison de ce qui précède.

La NFL se réserve le droit de retirer, d'annuler, de modifier ou de suspendre ce programme (ou de modifier les présentes conditions) de quelque manière que ce soit, sans notification ni obligation préalable, y compris dans le cas d'une cause échappant au contrôle raisonnable de la NFL qui interfère avec le bon déroulement de ce programme. tel qu'il est prévu par les présentes conditions, notamment les erreurs, accidents, problèmes, virus informatiques, bogues, falsifications, interventions non autorisées, fraudes ou défaillances de quelque nature que ce soit. Toute tentative de miner le fonctionnement légitime de ce programme de quelque manière que ce soit (comme déterminé par la NFL à sa discrétion exclusive) peut constituer une infraction aux lois criminelles et civiles, et si une telle tentative est faite, la NFL se réserve le droit d'exercer toute voie de droit et de demander des dommages-intérêts dans toute la mesure permise par la loi.

La NFL se réserve le droit, assujetti uniquement à l'approbation de la Régie au Québec, d'annuler, de modifier ou de suspendre ce programme ou de modifier ces conditions, de toute façon que ce soit sans un avis ou une obligation au préalable, en cas de tout accident ou de toute erreur d'imprimerie, administrative ou autre de tout type ou pour toute autre raison que ce soit.

Pour les résidents du Québec : Tout litige relativement à la conduite ou à l'organisation d'un concours publicitaire peut être soumis au jugement de la Régie des alcools, des courses et des jeux. Tout litige concernant la remise d'un prix peut être soumis au conseil uniquement aux fins d'aider les parties à parvenir à un règlement.

En participant à ce programme, chaque participant(e) (et son parent ou tuteur(trice) légal(e) en son nom si le (la) participant(e) est d'âge mineur) consent expressément à ce que la NFL ou ses mandataires stockent, partagent et utilisent les renseignements personnels soumis dans le but d'administrer le programme et conformément à la Politique de confidentialité de la NFL, disponible à l'adresse https://www.nfl.com/legal/privacy/fr. Cet article ne limite pas tout autre consentement qu'une personne peut donner à la NFL ou à d'autres personnes en ce qui concerne le recueil, l'utilisation et/ou la divulgation de ses renseignements personnels.

La NFL se réserve le droit, assujetti uniquement à l'approbation de la Régie au Québec d'ajuster toute date, échéancier et/ou autre mécanique du programme stipulée dans ces conditions, jusqu'à la portée jugée nécessaire par la NFL, aux fins de vérifier la conformité de tout participant, de toute candidature, de tout document de candidature, de toute demande, de tout document de demande, de tout vote et/ou de toute autre information à ces conditions, ou découlant de tout problème technique ou autre, ou à la lumière de toute autre circonstance qui, de l'avis de la NFL et à son unique et absolue discrétion, influe sur l'administration adéquate du programme, comme présenté dans ces conditions ou pour toute autre raison.

En cas de divergence ou d'incohérence entre les stipulations de cette version française des conditions et les divulgations ou autres déclarations contenues dans tout document lié au programme, y compris la version anglaise des présentes conditions ou la publicité dans les points de vente, à la télévision, imprimée ou en ligne et/ou toute instruction ou interprétation de ces conditions donnée par un représentant de la NFL, les stipulations des conditions en anglais prévalent dans toute la mesure permise par la loi.

L'invalidité ou l'inapplicabilité de toute disposition de ces conditions n'affectera pas la validité ou l'applicabilité de toute autre disposition. Si une disposition est jugée comme étant invalide ou autrement inapplicable ou illégale, ces conditions resteront autrement en vigueur et seront interprétées conformément aux conditions comme si la disposition invalide ou illégale ne figurait pas aux présentes.

Jusqu'aux limites permises par la loi en vigueur, tous les enjeux et toutes les questions portant sur la construction, la validité, l'interprétation et l'applicabilité de ces conditions ou les droits et obligations de participants, de la NFL et de n'importe quelle autre partie exonérée en lien avec le programme seront régis et interprétés conformément aux lois de la province de l'Ontario et aux lois fédérales du Canada applicables aux présentes, sans égard au choix de la loi ou au conflit de lois, conditions ou dispositions qui causerait l'application des lois de toute autre juridiction. Les parties conviennent aux présentes à la juridique exclusive et au site des tribunaux situés en Ontario dans tout recours à appliquer (ou autrement lié à) ces conditions ou liés à ce programme.
